Abstract

Biancu believes that the thesis of Höffe, according to which a retributive criminal law has an intercultural value and allows to overcome the difficulties related to cultural relativism, lead to the same practical results of that relativism which intend to fight, not allowing to identify sanctions that have a cross-cultural validity.
