Abstract
Free trade and investment protection agreements are being negotiated between the European Union and some of its principal trading partners. This essay intends to provide a brief overview of the current state of play, and specifically of the position of the European Union and of the agreements under negotiation in relation to substantive protection and investor-State dispute settlement provisions, and to provide some elements for reflection, addressing inter alia the proposals to abolish investor-State arbitration and to create a permanent investment court.
