Abstract
The increasing relevance of the category of “vulnerability” (i.e. “vulnerable subject”) within the contemporary philosophical-legal debate involves to remark its relation with the dimension of poverty. By considering the complex framework globalization-crisis of the State, the paper focuses on the pair vulnerability-poverty: the analysis allows to highlight the anthropological dimension underlying the horizon vulnerability-poverty and the legal profile of
the vulnerability as well as the phenomenology of poverty (i.e. the couple “static poverty”- “dynamic poverty”), which entails to improve the legal tools and the implementation of the policies. In the light of the current social complexity the circle vulnerability-poverty-politics-law, including its anthropological premises and the pivotal role of the constitutional concept of “person”, implies an in-depth rethinking of the pair vulnerability-poverty as regards the societal patterns and the legal theory.
