Abstract
The Author draws inspiration from two recent rulings of the Court of Cassation to delve into the issue of whether the arbitral award pronounced against the solvent debtor must be endowed with a certain prior date to be opposable to the insolvency practitioner in lodging claims admission proceedings. The Court relies on the principles of Joined Divisions of 2013 and 2021, respectively relating to the jurisdictional effectiveness of the arbitral award and the commencement of the annual appeal period from its last signature, to deduce that the award is ontologically endowed with a certain date. The Author, however, points out that in this case the basis for the admission of a lodging claim is the res judicata effect of the award against the debtor and not the award as act, which is certainly drawn up by arbitrators who do not hold the function of public officials.
