Abstract

The Joint Divisions of the Italian Supreme Court of Cassation – overturning a long-standing case-law – ruled that after an appeal concerning the legitimacy of a search and seizure order, pursuant to Section 325 ICPC the procedure to be followed before the Court of Cassation is the one provided for by Section 611 ICPC, without the attendance of the parties or the possible release of closing arguments.
