Abstract
The essay deals with the topic of liability of the public administration for the actions of its officials. The author first investigates whether it is vicarious liability or personal liability, then considers the implications on the distribution of the damages, according to art. 2055 c.c. The issue is examined from the two perspectives of public law and private law. The first tends to consider the official as a part of the administration, which is directly responsible for the illicit acts committed by the former. The second, on the contrary, is governed by the rules of the vicarious liability of the principal for the illicit act of the person in charge.
