Abstract

The essay mainly concerns the introduction and the fifth chapter of Ciaramelli’s book. The analysis is developed by summarizing the essential features of the legal method outlined in the volume and related with constitutional state . remarks a re made on the main theses proposed by Ciaramelli, emphasizing the important relationship between legal certainty, justification of legal decisions and interpretive discretion in constitutional state.
