Abstract
Based on an examination of the decisions of the EU Court of Justice and the Italian Courts concerning the breach of selective distribution agreements, the article identifies, on the one hand, under which conditions this type of agreement complies with antitrust law and, on the other hand, when the breach of a selective distribution system excludes trademark exhaustion and allows the owner to oppose the further circulation of goods, especially through e-commerce platforms.
