Abstract
Article 648 ter.1 of the Criminal Code provides for imprisonment for those who, after committing a non-culpable crime, employ, substitute or transfer into economic, financial or speculative activities money, goods or other benefits deriving from another crime. The Criminal Court of Cassation grants an applica-tion in accordance with an interpretation of “speculative activities” based on the literal argument, the teleological argument and the use of extensive interpretation. In these pages I examine the interpretative argumentation followed by the Court.
