Abstract
The essay analyses the latest enacted laws on therapeutic freedom and patient’s self-\r\ndetermination. The laws no. 24/2017 (so called “Gelli-Bianco”) and no. 219/2017\r\n(which regulates the informed consent) seem to invite the doctor to select autonomously\r\nthe therapeutic approach, to comply to public guidelines and to refuse useless or\r\ndisproportionate therapies. The Author poses questions related to the role of the\r\n“terminal” patient’s will in the choice of the therapy and also on the criminal issues\r\nof the interaction, even conflicting, between patient’s self-determination and doctor’s\r\nautonomy.
