Abstract

Leveraged cash outs have attracted much discussions, buy there is a more general question that needs attention: are "legal capital" rules on distribution the only set of rules limiting a company's ability to make a distribution in a wider sense? This paper was the first to suggest a combined application of the balance sheet test and of the insolvency test in the Italian environment.
