Le relazioni convenzionali dell'UE nel quadro del Consiglio d'Europa e le prospettive di adesione alla CEDU

The purpose of this article is firstly to provide an overview of the various instruments through which the EU's conventional relations within the Council of Europe are carried out. In this respect, the EU is a contracting party to a variety of agreements and arrangements differing in scope, which provide the legal framework for important forms of European cooperation. The article then focuses on the prospects for EU accession to the ECHR, which could represent a significant change in the relations between the two European organizations. After analyzing the solutions outlined in the draft accession agreement, it proceeds to address the most challenging issue, namely the judicial review of acts pertaining to the CFSP. This is left to an internal EU solution, in respect of which the Court of Justice's recent case law must be considered.
