Abstract
This article examines the relationship between insurance and civil liability in the specific field of compulsory insurance in respect of the use of motor vehicles.
Italian law establishes methods of calculation of damage to health, which are less favourable to victims than those provided for under the ordinary rules of civil liability.
The author underlines that this disparity shows a lack of justifications on Constitutional ground and also under European law.
Italian Constitution protects Health as a fundamental right, which can be balanced only with other constitutional rights.
On the other hand European insurance law tends to guarantee a fully compensation of non pecuniary loss in the field of road traffic accident.
