Abstract
The essay first reconstructs the contents of the Italy-Albania Protocol and the first acts aimed at its implementation. It then analyses the case law which, by not validating the measures to detain migrants taken in Albania, has led, on each occasion, to their transfer to Italy, despite the regulatory changes approved in the meantime. Finally, attention will be devoted to some brief considerations on the Italian Government's very recent decision to radically change the destination of the Albanian centres.
