Abstract

In the last quarter of the past century, Peru has adopted a new civil code in which, especially with regard to the law on obligations and contracts, Italian inspiration is evident. The Author describes the Italianizing turning point in Peruvian legal culture through references on the three formants of the Peruvian juridical experience, namely the legal, jurisprudential and doctrinal ones. He indicates some keys of interpretation and implications for the Italian civil law itself. Indeed, in terms of juridical comparison, the role of the Latin legal culture (the Latinity) in the international debate has so far been partly impromptu and marginal. The fact that nevertheless there have been some legal transplants in geographically very distant jurisdictions shows instead that the legal Latinity can play an important role that should be studied more and enhanced.
