Abstract

Called to rule on the subject of non-pecuniary damage from loss of the marital relationship deriving from wrongful act, the judges of the Cassation, while confirming the jurisprudential orientation that repents in the present case an alleged prejudice, they nevertheless refer to the need for a overall and unitary assessment of all the concretely relevant factual circumstances, for the purposes of the assessment of the actual injury to the legally protected interest.
