Abstract
In order to succeed its digital transformation, the European Union is willing to develop a single market for data, where citizens, companies and public authorities can use digital information to put forward a number of public and private interests. The Commission has detailed this project in the communication “A European strategy for data” published in February 2020. Aside from removing the obstacles to the access and free circulation of digital information, the single market for data requires both governance instruments meant to make data available in the Union and ambitious legal standards to prevent their misuse. The purpose of this article is to analyse the existing norms and legislative proposals, which are going to shape the European market for data and highlight the main strengths and weaknesses of the project also in the light of the relevant case law of the European Court of Justice.
