Abstract
One of the main consequences of overcoming the old regime is undoubtedly the advent of the new French-style administrative system, which gives the municipality, now fully integrated into the organization of the State as an entity
representing the interests of the local community, new legal status and powers.
Starting from a dispute that arose in the early 19th century between the town of Rovato and the community of the ancient inhabitants, following the dissolution of the rural guilds of medieval origin, this study aims in particular to analyze the historical and legal aspects linked to this phenomenon and the main issues arising from it.
