Abstract
The essay examines the main case law solutions concerning the employer’s chance of using private investigators to monitor employees. After outlining the state of the art, the author provides a critical analysis of the arguments that are often used by the Italian Supreme Court, focusing on certain issues such as surveillance measures to protect business assets and checks on absent workers. Particular attention is given to the features of the investigation and the links with data protection regulations.
