Abstract
Internal investigations inside complex organizations consist in a tool no longer unknown to the right of defence, both before and during criminal proceedings. At the same time, they represent an opportunity to give effective and alternative responses to profit-driven crime, through the adoption of restorative models. Nevertheless, internal investigations remain unknown to the Italian legislator, forcing the interpreter to search for not always manageable exegetical solutions in order to identify their limits and their systematic implications. Hence, the opportunity to reflect on some legislative reform proposals, also in light of the experiences gained in other legal systems, of Anglo-Saxon and continental origin.
