Abstract
The severe environmental and industrial crisis concerning the ILVA steel plant in Taranto has been dealt with, in 2012, through a reconsidered IPPC authorization and decree-law n. 207, suspending the judicial seizure of the plant. In judgment n. 85/2013, the Constitutional court upheld the decree-law against judicial challenges. The essay highlights some contents of decree-law n. 207/2012 and judgment n. 85/2013, which are relevant in the perspective of current trends in the form of government, theories on constitutional rights and sources of law, and boundaries between legislation, administration, and the judiciary.
