Abstract

Topics relating to the protection of breeder’s rights are dealt with regard to the special case of essentially derived varieties . Starting from the 1991 UPOV Convention Act, legal sources to which one has to refer in view of entering into a dispute on this subject are recalled. Criteria and methods to be applied when cases of possible essential derivation might be recognized are then summarized, on bibliographic basis.
