Abstract
Modernity has effected what has been aptly dubbed a “horror pleni”, namely an abundance of stimuli and things, a loss of the interval and of the pauses, which have largely deprived the individual of his thoughtfulness, and thus of the ability to create and perceive between self and neighbor, between one's age and the next a "pause", so vital for considering the different sides of reality and thus for ethical behaviors, for really beign able to pay attention to other’s humanity and needs. The outcomes of such anthropological development have deepened during the so called late-modernity, even affecting criminal justice and enhancing “punitiveness”: a term and a concept not well defined, which however can convey the idea of a general social attitude prone to search and punish the culprit whenever a problem or a conflict arise, instead of trying to understand ina dvance the situation and thus acting on the roots of bad behaviors before the time a punishment is unavoidable.
