Abstract
Right to health and health systems to the test of the pandemic. The 'lessons' of some
National Recovery and Resilience Plans – The pandemic emergency has highlighted that, in
certain contexts, science is a necessary interlocutor of politics, thus re-proposing and
catalyzing the reflection on the relationship between political decision-maker and scientific
expertise. In particular, the essay analyzes how the regulatory paradigm resulting from the
interaction of the two factors during the pandemic is configured and legitimized, both with
reference to its construction and in relation to judicial review, taking into account the
theoretical perspective, as well as the impact of the evidence-based rule-making on the form
of State and of government.
