Abstract
The essay addresses the relation between law, technology and safety (security). The affirmation of new technologies involves anthropological reflexes as well as legal-institutional modifications. From an epistemic and categorical point of view this process calls into question the transition from Modernity to Post-modernity (or Ultra-modernity). The ongoing transformation of the modern concepts of “law”, “technology” and “safety (security)” implies relevant corollaries: a new interlacing law-technology, a particular development of technology (based on the combination of autonomy, increasing specialization, interconnection among different social spheres related to the complexity of new technologies) and a more articulated circle ‘law-technology-safety’ (in particular as regards individual privacy). In a philosophical-legal perspective relevant questions emerge: what is the nature of (new) law implemented by technology? Can we really “control” the new securitarian technologies through politics and law? Are we facing a reconfiguration of the nexus law-(safety)security?
