Abstract

The purpose of this essay is to enhance the understanding of the post- civil code in the Kingdom of Italy, by focusing on the issue of Jewish minors being converted into invitis parentibus. This is a very ancient issue that compromised relations between Judaism and Christianity, which only formally followed Aquinas contrary indication. The Napoleonic Code Civil represents a stumbling block in the context of Napoleonic Italy. The case study of Judith and Esther Padovani (1811-1813) will appear paradigmatic to capture continuity and discontinuity in the attitude of the government, of the world of jurists and of society at every level.
