The Italian Supreme Court stated that the appointment of “legitimate heirs” as beneficiaries of a life insurance aims to name not the subjects who actually acquire the title of heir but those who are “entitled to be appointed as heir” at the time of the opening of the succession. In the event of premature death of the third party beneficiary, the insurance compensation will be paid to the heirs of the predeceased in the measure which is due to the latter.
