[Autom. eng. transl.] The issue of administrative deliberation has not been the subject of further specific studies in doctrine, although in positive law, even in the limited field of investigation represented by the main normative texts on public administration, the reference to «deliberation» is very frequent. And yet the distinct reference, if not the intentional juxtaposition, between «deliberations», «dispositions» and «provisions» - which emerges in relatively recent legislative interventions (see in particular art. 27, law 30 March 2001, n. 165) - corroborates the conviction that there is a proprium of deliberation, not reducible to the element of collegiality: the resolution could, if possible, indicate, on the basis of the id quod plerumque accidit in positive law, the expression of the will of the organs with powers of direction (not necessarily political, but also an expression of functional autonomy).
