Abstract

[Autom. eng. transl.] The Gelli-Bianco law has extended the compensation criteria contained in articles 138 and 139 of the Insurance Code for damages caused to the patient. These rules, which respectively concern minor injuries (so-called macropermanent) and minor injuries (so-called micropermanent), give rise to a form of limitation of compensation with respect to the level of full compensation. There. critically analyzes this extension, not identifying a reason capable of justifying, also in relation to the general principle of equality, the favor recognized to the healthcare structure and to the operator the healthcare profession, as instead it was able to find as regards the rc sector car.
