Abstract

[Autom. eng. transl.] The paper analyzes the sentence of the Court of Cassation, Section III criminal, n. 37166 of 18 May 2016 - 7 September 2016, focusing on the crime of sexual violence committed with the victim being induced into error by profiting from the latter's inferiority condition. The note reconstructs the doctrinal and jurisprudential panorama on the crime referred to in art. 609 bis, co. 2, n. 1 cp, focusing on the concept of "inferiority condition" and on the different syndromes that can be classified within eating disorders, disorders that, in the reference sentence, determined the inferior condition of the victims. In particular, anorexia nervosa is analyzed, object of various pronouncements of the jurisprudence of legitimacy due to the deep incision that it causes on the psychological stability of the people who are affected. The analysis then continues through some reflections about the correct classification of the legal asset being protected when the crime of sexual violence is perpetrated within a fiduciary relationship such as that existing between doctor and patient.
