Abstract

[Autom. eng. transl.] This stage in the evolution of bancassurance is characterized by the combination of life and non-life insurance products with the offer of banking and financial products. The bank organizes this sale considering it suitable to create value for the bank and its customers. However, the combination of insurance products is not free from critical issues arising from the asymmetry in the negotiating and cognitive positions of the bank and of the customers/policyholders. This has led the Italian and European legislator, as well as the supervisory and regulatory authorities, to intervene on several occasions in an attempt to eliminate them, as well as sanction them. The investigation aims to evaluate how the rules introduced for this purpose are likely to affect the organization that makes this combination possible, which is paradigmatic of a serial contract. We will therefore examine the tools prepared by the legal system to protect the mass of customers/policyholders, not the individual, also assessing the impact on the content of the insurance contract offered in combination.
