Abstract

[Autom. eng. transl.] The author comments adamantly on the decision with which the Court of Cassation - retracing its steps with respect to what was held in the first ruling following the reform of false corporate communications (L. May 27, 2015, n. 69) - recognizes the persistent criminal relevance of the false evaluations, as they can be subsumed under the normative phrase "relevant material facts that do not correspond to the truth". He also considers that the failure to repeat the adjective "relevant", in relation to the commissions charged with the art. 2622 of the Italian Civil Code, which can be overcome in an interpretative manner and expresses a critical position on the comparison made by the SC between "false evaluation" and "false qualitative", which are figures that are distinct from one another and cannot be superimposed.
