Abstract
[Autom. eng. transl.] The counterfeit damage of the trademark refers to a quantum debeatur which is often not easy to determine and is based on various economic criteria, from time to time applicable to the specific case. The application of best practices and integrated assessment standards, such as ISO 10668, proposed at the international level, reduces the evaluator's margins of discretion and must be appropriately adapted to the damage that is detected from time to time, considering economic aspects and financial (such as lost royalties), or an impoverishment of a patrimonial nature. The accounting of brands and costs and revenues that emanate from them, albeit with the typical criticalities of intangibles, represents a precious and often irreplaceable historical information base for estimates of emerging damage and loss of profit, even at a prospective level.
