Abstract

[Autom. eng. transl.] The annotated sentence intervenes with regard to the clause contained in the general terms and conditions of a savings bank, according to which the currency on cash payments made by the customer starts from the first working day following that of payment; according to the ruling, this clause disproportionately affects the customer and is therefore ineffective. The AAs, recalling the present case, examine the decision and evaluate its scope on a practical level. They then draw inspiration from the German judge's decision to make some considerations on the application in Italy of the matter in question in the light of the current banking legislation.
