Abstract

[Autom. eng. transl.] The text constitutes a comment having as its object the letter of Pope Francis of May 30, 2014 to the participants in the XIX International Congress of the International Association of Criminal Law and the III Congress of the Latin American Association of Criminal Law and Criminology. Of this letter we highlight above all the clear taking of distance - very clear in the quotation given in the commentary - from the remuneration idea of the penalty, in favor of a "justice that is humanizing, genuinely reconciling" and aimed at the "total reintegration" of the condemned in the community ": this position, which defines, in a definitive way, the point of view on the subject of the Catholic Church, with respect to the misconceptions of past centuries. Some significant annotations of criminal policy are also noted, in particular on criminogenic models agents in society and on the inadequacy of the ways in which the criminal problem is generally represented by the media.
