Abstract

[Autom. eng. transl.] The contribution includes - with a brief introduction explaining its origins - a large project, requested in 2007 from the Author by the Pontifical Council for Justice and Pax, for a document of the same Pontifical Council, and therefore of the Catholic Church, on the penal question. It is oriented towards the abandonment, also from the theological point of view, of retributive visions of justice, according to an openness to the orientations of restorative justice. In addition, I pay particular attention to criminal policy, not just penal law. Although the aforementioned project was not translated, at the time, into an official document, it seemed significant to propose it again as still significant material for ecclesial reflection on the matter and for any Church texts that take up the entire problem: both in relation to systems penal laws of States, and in relation to canonical penal law.
