[Autom. eng. transl.] With the sent. December 20, 2017, n. 275 the Court examines the question of constitutional legitimacy of the art. 10, paragraph 2, of Legislative Decree 286/1998, a provision that provides for the so-called "deferred" rejection, by means of a forced accompaniment of the foreigner at the border. The Court, while declaring the inadmissibility of the question due to lack of relevance, does not exempt itself from sending a "warning" to the legislator: the forced accompaniment to the border, precisely because it is a coercive measure, involves a restriction of personal freedom and therefore requires a regulation in accordance with what was established by art. 13, paragraph 3 of the Constitution, with particular reference to the respect of the reserve of jurisdiction established therein.
