Abstract

[Autom. eng. transl.] The paper analyzes the penal and administrative sanctioning system developed by the Italian legislator to counteract the phenomena of market abuse (insider trading and market manipulation), in the light of the recent ruling with which the European Court of Human Rights, in relation to in the case of the equity swap Ifil-Exor, it condemned Italy for violating the right to a fair trial and for violating the right not to be tried or punished twice for the same deed. The current structure of the administrative procedure regulated by Consob, which exposes Italy, in the near future, to new complaints by the Court of Strasbourg, is particularly critical, especially in light of the considerations contained in the dis-senting opinion drafted by two judges of the EDU Court.
