Tra frontiere e confini. Il diritto penale dell'età multiculturale

[Autom. eng. transl.] The work concerns the problem of so-called culturally oriented crimes in the Italian legal system and in that of Western countries that are more concerned with multiculturalism. After having dealt with the essential issue of the importance of cultural belonging in supranational sources and in the jurisprudence of the Edu Court, the de iure condito and de lege ferenda solutions elaborated by the criminal law doctrine are examined, as well as the most important jurisprudential judgments. At the end of the reflection, an original political-criminal proposal is formulated that uses restorative justice, creating moments of complementarity between the punitive system and the reparative one.
