The Impact of Law 53/00 (Regulation of Parental Leave) on Fathers: a Good Law Disregard in Daily Life

Abstract

A fundamental objective of the law 53/2000 is the identification of concrete yet flexible tools that allow for a reconciling of contrasting personal and working needs. This regulatory measure is innovative: it presents a vision of parenting as a shared task of co-responsibility, as a relationship between the parents. The measure takes into consideration the ethics of caretaking and is characterized by the value of reciprocity. However, the data on the use of parental leaves by the general population present a stark contrast to the new law: in daily life there is an almost complete disregard of the principles of equality that inspired the new regulation.
