Abstract

In this article, the following ideas are advanced: a) that the "dédoublement fonctionnel" is (still) an useful theoretical model, as far as the relations among legal systems - in the framework of the "mise en oeuvre" of UN counter-terrorism measures -are concerned); b) that a judicial control of UN resolution can be made by the ECJ from the point of view of some basic legal values of the EU legal system ; c) that these legal values (i.e. access to justice and fair trail) can be hardly drawn from the UN legal system in the current historical moment.
