Abstract
[Autom. eng. transl.] The text examines the criteria for the attribution of criminal responsibility in canon law, through a comparison with the criminal law of the State. Assumed considerations on the relevant offense in the canonical context and on the aims pursued through the penal intervention, as well as on the extension of the latter, the notions of malice and guilt and the meaning that the category of guilt assumes are analyzed. The role of conduct with respect to the cause of the event is also examined in depth. The necessity of an evolution of the canonical sanctioning system in the sense of restorative justice is highlighted, recognizing in it the orientation more in line with its objectives. In such a context the position of the victim is also assessed.
