Abstract
[Autom. eng. transl.] The note highlights how not only the administrative jurisprudence, but also the Civil Cassation, tends to frame the responsibility of the public administration in the context of special responsibility figures, instead of tracing it back to the ordinary figures of a disciplinary offense in the civil code. In particular, in the work it is maintained that the responsibility of the administration for the assignment generated in the awarding party following jurisdictional cancellation of an award, is attributable to the contractual responsibility.
