Abstract
[Autom. eng. transl.] The essay, which takes its cue from the norms of the Ticino penal codes of 1816 and 1873 which regulate the consequences of the ignorantia legis in criminalibus, proposes to draw a brief overview of the main differences between this common law tradition - here analyzed in its late seven-nineteenth-century offshoots - and the new perspective of codified law. It is in fact with the affirmation of the new normative form that takes shape, in contrast with the more articulated solutions typical of the ius commune, a radical simplification of the discipline in this field, with the exclusion of any exempting effect of the innocent ignorance of the provisions incriminatory. This rigorous landing, which is a consequence of the Enlightenment trust in the possibility of delineation of a criminal law inspired by the most absolute certainty and which appears to see how the statistic counterpart of the guarantees connected to the establishment of the principle of legality, will however be progressively challenged in a recent era, with the resurfacing of solutions - developed at both legislative and jurisdictional level - aimed at recovering at least in part the complexity underlying the reflections elaborated, in this field, from the criminalization of the pre-codifying tradition.
