Abstract

[Autom. eng. transl.] The study takes its cue from the dramatic problem of prison overcrowding denounced by prisoners, institutional bodies, magistrates and prison workers. Since the restoration of legality in the execution of the sentence is achieved not only through the reduction of the prison population, but also through a system of remedies actually suitable to end detention against legem, the contribution proposes to analyze the tools prepared in our system penitentiary to protect the rights of prisoners and to highlight the gaps and critical points, identifying possible preventive and compensatory remedies that can be used in the event of damage to prisoners' rights
