Abstract

[Autom. eng. transl.] The volume analyzes the developments of the incidental judgment on the laws in light of the dual purpose that characterizes it: the guarantee of the constitutional legality of the order and the protection of the subjective situations involved in the judgment in the main proceedings. The examination of the jurisprudence of the Court, with particular reference to some "key" profiles of the incidental judgment, such as the determination of the object of the question of constitutionality, its "relevance" and the position of the parties, helps to reconstruct the evolution of the 'institute, also in view of the classic contrast between concrete systems and abstract systems of constitutional justice and offers food for thought to verify if and in which terms the constitutional judgment can be qualified as a "process" and falls within the field of application of the art. 111 of the Constitution.
