Abstract
[Autom. eng. transl.] The contribution starts from the ruling in the United Sections in the Mantova Petroli case, to retrace the jurisprudence on the matter of defining the relationship between criminal property sanctions and the protection of insolvency creditors. Historically, the topic has given rise to a lively doctrinal and jurisprudential debate, which only recently has found an adequate regulatory definition with the entry into force of the Corporate Crisis and Insolvency Code.
