Abstract

[Autom. eng. transl.] This paper has as its object the study of the tariff regulation function of public services of economic importance or, according to the European denomination, services of general economic interest (SGEI). After a few brief premises regarding the notion of 'tariff' and the inverse proportionality relationship between tariff regulation and the competitive development of the markets relating to the various SGEIs, the investigation continues with a diachronic analysis of the Italian tariff policy in order to highlight the evolution from the original macroeconomic and, mainly, anti-inflationary approach to the new paradigm of 'efficiency regulation'. The central part of the work is dedicated to the study of the two fundamental methods of tariff regulation: the 'Cost of Service' and 'Price-Cap' models. With regard to the second, the analysis focuses on two main critical issues, namely the level of productivity payable by regulated companies and the necessary imposition of qualitative supply obligations in order not to frustrate the development objectives of production efficiency. In the final part of the paper, the implications on tariff matters related to the fundamental principles of economy and profitability are investigated, generally enunciated by law no. 481. In this regard, particular attention is paid to identifying the 'policy' options underlying the regulatory choices in question, with a broader critical reflection on the validity of the theoretical assumption relating to the alleged 'technical neutrality the power to regulate tariffs, especially where exercised by independent administrative authorities. A possible solution to the critical issues indicated can be found on the level of the criteria for the allocation of fees in the matter of tariffs. To this end, the fundamental distinction between 'social regulation' (or 'redistributive') and 'economic regulation' will be assumed as the basis for the distribution of functions between authorities with different legitimacy (i.e. political-representative or technical).
