Abstract

[Autom. eng. transl.] In the context of an advanced civil law manual, which aims to combine informative exposure with a critical-reconstructive approach and is aimed in particular at the preparation of the competition in the judiciary and the specialized operators of the law, the chapter deals with the issue of resolution of the contract due to excessive burdensome occurrence and that of the presupposition. Of this last figure a particularly problematic framework is provided, which shows how in the hypothesis of the occurrence of a disturbing element the resolution ends up circumventing the limits set by the art. 1467 cc for translational contracts, while in the failure to fulfill the future element assumed by the parties the resolution does not find justification in the concrete case and determines a systematic dystonia with the art. 1465 cc
