Abstract

Moving from the analysis of the new provision concerning the penal code reserve in the criminal matter (art. 3-bis c.p.), the essay aims at questioning which could be the more appropriate relationship between the penal code and the complementary criminal law. As the fair-warning principle can be intended to be the new provision rationale, also on the basis a general scheme has been pinpointed in the pyramidal model, which is deeply connected with strategies of pyramidal enforcement and responsive regulation. Several elements arising from the complementary criminal law are taken into account in order to verify the feasability of this model.
